Lawsuit Filed by Children of Woman Killed in Crash

The attorney for four Manitowoc, Wisconsin children, ranging in age between eight and 15, has filed a wrongful death lawsuit against two people involved in the accident and State Farm Mutual Automobile Insurance Company. The children are seeking compensation for funeral and burial expenses. The lawsuit also states the children were "entitled to her aid, society and companionship." The Wisconsin Department of Health and Family Services was named as the plaintiff in the case.

The lawsuit claims that the two defendants negligently operated their vehicles on February 17, 2006 when they crashed on State Highway 310. The children's 32-year-old mother was a passenger in one of the vehicles, and was ejected. She was not wearing a seatbelt at the time of the accident. According to the lawsuit, the woman died "after a period of conscious pain and suffering" and the negligence of the drivers.

If you have lost a loved one in an auto accident due to another's negligence, you may have cause to file a wrongful death suit. In the case of these children, the compensation will not only go toward costs associated with the funeral and burial, but toward intangibles such as loss of companionship, bereavement, and other emotional needs.

If you have suffered the loss of a loved one and would like to discuss a wrongful death suit, please contact an experienced personal injury attorney in your area.
